New tax laws which went into effect in 2005 allow donors, in most cases, to claim for a deduction the actual selling price of the donation (when sold for the charity), hence higher selling prices will mean in most cases a bigger potential deduction for the donor. Donors are no longer able to legally claim in most cases “appraised values” or “estimated values” of property donations for tax deduction purposes. The IRS now allows in most cases the donor to claim the actual selling price of the property you donate. We always recommend donors check with their tax preparer or advisor before claiming a tax deduction. There are some exceptions to the IRS “gross selling price” rule which apply to certain “high value” donations or property used by the charity to fulfill the charity’s mission and which will qualify for the “significant intervening use” rule.
